Implementing the Family Law Act 1996 Edwards (2001a) considered whether the FLA brought about any change to the effectiveness of the civil law protection for victims of domestic violence by examining the annual trends in injunctive relief prior to and following implementation.

This might be regarded as an overly optimistic assessment of the improvements to police practice. Edwards notes another possible, ‘more invidious’, explanation is that judges became reluctant to grant non-molestation orders in situations where they did not want to attach a power of arrest but would have legislatively been required to do so. Despite these concerns Edwards concludes that ‘bringing the remedies under one Act has produced a more effective remedy for dealing with domestic violence’. This view seems to be shared by voluntary sector support agencies providing services for victims of domestic violence.

Originally this was further defined in FLA, s 41 so that the courts were required to have regard to the fact that the parties had not given each other the commitment involved in marriage. It was generally felt that the provision was meaningless and only inserted to appease those who felt that the legislation should not be seen to be undermining marriage. The Domestic Violence, Crime and Victims Act 2004 repeals FLA, s 41 but adds to the provision on the nature of the relationship the words ‘and in particular the level of commitment involved in it’.
