Implementing the Family Law Act 1996 Edwards (2001a) considered whether the FLA brought about any change to the effectiveness of the civil law protection for victims of domestic violence by examining the annual trends in injunctive relief prior to and following implementation.

Edwards notes another possible, ‘more invidious’, explanation is that judges became reluctant to grant non-molestation orders in situations where they did not want to attach a power of arrest but would have legislatively been required to do so.
