The conspirators are not more public-minded than Caesar’s citizens, only differently public, and with a different relationship to state power. The familiar interpretation of Julius Caesar is that Brutus and the conspirators represent a kind of nascent public sphere that is outside of the state and that checks the dictatorial state power that Caesar represents. In fact, however, the conspirators do not see themselves as operating outside the state at all, only as embodying a different relationship to the state than either Caesar or the public citizenry Caesar conjures up.

Measure for Measure brings to the stage a form of life that is triggered when characters experience themselves as radically subjected to an arbitrary legal code, and then experience this subjection as a force that spins them out of the gravity of the legal and political order altogether. I. Sovereignty and the Legal System I want to begin by describing how Shakespeare represents the early modern legal system, and specifically how he represents the point of crisis in the legal system that energizes the life of the flesh.

Pervaded as it is by anti-social desires—the desire to kill, the desire to be killed—this war is not so much the continuation of politics by other means (as Clausewitz’s famous formula would have it) as it is the replacement of politics by other means. By bringing this fundamentally perverse and even anti-social war to the early modern stage, Shakespeare reveals a strangely inhuman social life—founded in “bare life” and mediated by bodies and their fluid humors—that rises beyond the iron clasp of state and state-mediated civil society.
